Terms and Conditions of Attendance and Participation
These are the terms (the "Agreement") governing your attendance at and participation in any Right of Boom, LLC event (the "Event" or the "Right of Boom Events").
By registering for the Event you agree to this Agreement, which forms a binding legal contract between Right of Boom, LLC ("Right of Boom") and the registered attendee or participant ("you"). If you are registering on behalf of another individual, it is your responsibility to ensure the person attending is aware of these terms and accepts them. By completing the registration on behalf of another individual you are warranting that you have made the attendee or participant aware of these terms and that they have accepted these terms.
1. Attendee Requirements
1.1 Admittance. Your registration entitles you to admittance to the Event for which you have registered. Any and all other costs associated with your attendance (including without limitation travel and accommodation expenses) shall be borne solely by you, and Right of Boom shall have no liability for such costs.
1.2 Use of Likeness. By attending the Event you acknowledge and agree to grant Right of Boom the right at the Event to record, film, photograph, or capture your likeness in any media now available or hereafter developed and to distribute, broadcast, use, or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you. This grant to Right of Boom includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use or disseminate the media.
1.3 Event Content. You acknowledge and agree that Right of Boom, in its sole discretion, reserves the right to change any and all aspects of the Event, including but not limited to, the Event name, themes, content, program, speakers, performers, hosts, moderators, venue, and time.
1.4 Age Requirements. No one under the age of 21, including children in strollers accompanying their parents, will be admitted.
1.5 Identification. All attendees must provide two forms of identification: one government-issued photo ID and one document proving their affiliation with the company name appearing on their registration (pay stub, business card, etc.).
1.6 Visa Requirements. It is the sole responsibility of the attendee to take care of any government visa requirements. Attendees who require an entry visa should allow sufficient time for the application procedure. Attendees should contact the nearest embassy or consulate to determine the appropriate timing of their visa applications. Right of Boom will not contact embassies and consulates on behalf of visa applicants or provide any other assistance relating to visa issues. Failure to obtain a visa in advance of an Event does not constitute a valid basis for obtaining a refund.
2. Prohibited Conduct
2.1 Limitations on Use. By registering for a complimentary Right of Boom Events pass you agree not to sell, trade, transfer, or share your complimentary code or badge. By registering for a paid Right of Boom Event Pass, you agree not to share, sell or trade your badge. In the event that Right of Boom determines that you have violated this policy, Right of Boom may cancel your badge(s), retain any payments made by you, report you to law enforcement authorities, and ban you from future Right of Boom Events.
2.2 Disruptive Conduct. You acknowledge and agree that Right of Boom reserves the right to remove you from the Event if Right of Boom, in its sole discretion, determines that your presence or behavior creates a disruption or hinder the Event or the enjoyment of the Event by other attendees. All Right of Boom badges are the property of Right of Boom and must be returned to Right of Boom upon request.
2.3 Badge Misuse. Attendees wearing badges from previous Right of Boom Events or falsified badges and/or sharing or swapping badges will be immediately ejected from the Event and banned from future Events. Right of Boom considers such conduct theft of service, trespassing, and fraud and will report violators to law enforcement authorities. If such conduct is discovered after an Event, violators will be invoiced according to onsite registration pricing and will be required to pay their invoice in full.
2.4 Suitcasing. "Suitcasing" refers to the practice of attending a trade show but "working the aisles" from a suitcase or briefcase, soliciting business from other attendees and exhibitors. For the good of the show and the exhibitors supporting the show, the only legitimate place to conduct business during show hours is within a contracted exhibit space on the show floor. Exhibiting companies are encouraged to protect their investment and report any violations to Right of Boom management. Attendees observed soliciting business in the aisles or other public spaces, or in another company’s booth, will be ejected from the Event and may be banned from future events in Right of Boom’s sole discretion.
2.5 Photography, Recording, Live Streaming, and Videotaping. Attendees may not record or broadcast audio or video of sessions at Right of Boom Events. Right of Boom allows cameras on the show floor. Attendees may take pictures within the show for purposes of company or annual reports, company media pieces, marketing materials, etc.
2.6 Unethical/Non-Compliant Marketing. Right of Boom reserves the right to deny admission to anyone who engages in or is reputed to engage in unethical or non-compliant marketing practices.
2.7 Code of Conduct. Without limiting the terms of this Agreement, in connection with each Event you must comply with the Right of Boom Events Code of Conduct, as updated by Right of Boom from time to time, attached hereto as Exhibit A (the "Events Code of Conduct").
2.8 Failure to Comply. Without limiting any other remedy under the Agreement or applicable law, if you fail to comply with this Agreement or any other agreement between you and Right of Boom or any Right of Boom affiliate, Right of Boom may take any action it deems appropriate in response, including canceling your Event registration without any refund or banning you from the applicable Event or any or all other Events.
2.9 Right to Restrict and Cancel. In addition to the requirements and prohibitions set forth in this Section 2, Right of Boom may also exclude any prospective attendee from registering for or attending any Event, in Right of Boom’s sole discretion. Furthermore, Right of Boom reserves the right to cancel, in its sole discretion, any attendee’s registration upon refund of the admission fees paid to Right of Boom; provided, however, that if an attendee is canceled for violating any prohibition or requirement set forth in this Section 2, Right of Boom may retain all fees paid.
3. Fees
3.1 Payment. The payment of the applicable fees for the Event is due upon registration. If such payment is insufficient or declined for any reason Right of Boom may refuse to admit you to the Event and shall have no liability in that regard.
3.2 Taxes. The fees may be subject to sales tax, value added tax, or other taxes and duties which, if applicable, will be charged to you in addition to the fees.
4. Badges
4.1 Attendee badges must be worn at all times in Event areas.
4.2 Once you have received your badge on site, it cannot be changed, substituted, or reissued to a different person.
4.3 If your badge is lost, a replacement will only be issued at the current onsite rate.
4.4 Right of Boom will use the personal data you provide to Right of Boom in accordance with our privacy policy attached hereto.
4.5 For an in-person Event, an Event badge may be available for you to pick up at the designated check-in area of the Event venue during the scheduled Event dates. You will not be admitted into the Event venue without an Event badge. Badges may contain RFID or NFC tags or other technology that may be used to record your attendance and participation in the Event (including visiting booths and attending sessions). By allowing your badge to be scanned at an Event, you hereby authorize the operator of the badge scanner to collect and process such information. You acknowledge that if your badge is scanned by or for any sponsor or other third party with a badge scanner (each, an "Event Sponsor"), then that Event Sponsor may have access to a third-party report that includes such attendance and participation information, and also certain of your Registration Information.
4.6 Right of Boom is not responsible for the privacy practices of any Event Sponsor or other third party. Please contact the Event Sponsor or third party to learn more about its practices with respect to any information that it collects. For clarity, to the extent that Right of Boom collects any Personal Data regarding your attendance or participation in the Event for Right of Boom’s use, it will be subject to Right of Boom’s Privacy Statement. If you do not wish to permit the uses and disclosures of information described in this Section, for an in-person Event do not allow any Event Sponsor or third party to scan your badge at any Event and for a virtual Event, do not attend the Event.
4.7 For virtual Events You acknowledge, agree and accept the virtual platform, Right of Boom may share your information with any of our vendors and Event Sponsors, and that Right of Boom, and our vendors and Event Sponsors, may follow-up with you about products and services that we think you may be interested in. This may be based on information about your interaction with the Event and its content together with the information we hold about you.
5. Registration Confirmation
5.1 Once you have completed your registration, you will receive your registration confirmation by email. Please ensure that your valid email is entered correctly on the registration form. Be sure to check your junk email box in case any of your Right of Boom email(s) are caught by spam filters.
5.2 You will receive essential information for registered attendees electronically at the email address and mailing address that was provided on your registration form.
6. Government Employees and Officials
6.1 If you are a government employee or official, you must identify yourself as such during the registration process for an Event, and, for an in-person Event, you may be asked to present your government-issued employee badge during the check-in process.
6.2 If you are a government employee or official and you are offered free or discounted attendance or participation at an Event, you must disclose your attendance at the Event to your employing government agency in advance, and obtain such agency’s permission for you to accept free or discounted attendance at such Event. You must also confirm your compliance with the foregoing upon request by Right of Boom.
6.3 If you are a government employee or official, you must also comply, for the entire duration of the Event, with all applicable rules and regulations imposed by your employing agency, including those rules and regulations relating to the acceptance and disclosure of gifts and gratuities.
7. Changes to Events
7.1 Events are subject to change at any time. Right of Boom does not guarantee the attendance of any third party (including any exhibitor or speaker), or that any scheduled session, breakout, keynote or other activity will take place.
7.2 Right of Boom reserves the right, including without prior notice, to make any change to an Event program or format at any time for any reason (including modification of the schedule or content of, or cancellation of, any session, breakout, keynote or other activity). Right of Boom is not responsible for, and no reimbursement will be issued in the event of, any change to an Event (including modification of the overall Event program, or the schedule or content of, or cancellation of, any session, keynote or other activity).
8. Security
Right of Boom reserves the right, including without prior notice, to take any security measures it deems appropriate for the safety of attendees and participants of in-person Events.
You will comply with all such security measures, including the following:
- At all times during an in-person Event (including at any Event venue or during any Event session, keynote or other activity), you will wear your Event badge such that it is visible to other Event attendees and participants. You will not share or exchange your Event badge with any other person. Failure to comply with this requirement may result in confiscation of your Event badge and termination of your attendance or participation in the Event.
- Bags may be checked randomly during certain hours of an in-person Event.
- You will not leave any bags or other property unattended at any time. Unattended property may be removed.
- Items prohibited at in-person Events include: firearms and other weapons, explosives, and other hazardous materials or articles. You will not bring with you or have in your possession any such items at any time during your attendance at an in-person Event.
9. Affiliated Services
The Right of Boom Events mobile application (or any other application or website through which you may register for an Event or access Event information or materials) may contain or make available information on accommodation, transportation, and other services provided by third parties (each, an "Affiliated Service"). For clarity, Affiliated Services are Third Party Materials. For further clarity, hotel reservations are provided as an Affiliated Service, and Right of Boom is not responsible for any issues or disputes between you and any hotel. You will be responsible for complying with the hotel’s cancellation policy, including if an Event is canceled for any reason.
10. Intellectual Property
10.1 All intellectual property rights in and to the Event, the Event content, and all materials distributed at or in connection with the Event are owned by Right of Boom or the Event sponsors or speakers presenting at the Event. You may not use or reproduce or allow anyone to use or reproduce any trademarks or other trade names appearing at the Event, in any Event content or in any materials distributed at or in connection with the Event for any reason without the prior written permission of Right of Boom.
10.2 For the avoidance of doubt, nothing in this Agreement shall be deemed to vest in you any legal or beneficial right in or to any trademarks or other intellectual property rights owned or used under license by Right of Boom, LLC or any of its affiliates; nor does this Agreement grant to you any right or license to any other intellectual property rights of Right of Boom, LLC or its affiliates, all of which shall at all times remain the exclusive property of Right of Boom, LLC and its affiliates.
11. Disclaimer of Warranties, Limitation of Liability
11.1 Right of Boom gives no warranties in respect of any aspect of the Event or any materials related thereto or offered at the Event and, to the fullest extent possible under the laws governing this Agreement, disclaims all implied warranties, including but not limited to warranties of fitness for a particular purpose, accuracy, timeliness, and merchantability. The Event is provided on an "as-is" basis. Neither Right of Boom nor its affiliates accept any responsibility or liability for reliance by you or any person on any aspect of the Event or any information provided at the Event.
11.2 EXCEPT AS REQUIRED BY LAW, NEITHER RIGHT OF BOOM NOR ITS AFFILIATES SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL COSTS, DAMAGES OR LOSSES ARISING DIRECTLY OR INDIRECTLY FROM THE EVENT OR OTHER ASPECT RELATED THERETO OR IN CONNECTION WITH THIS AGREEMENT.
11.3 THE MAXIMUM AGGREGATE LIABILITY OF RIGHT OF BOOM FOR ANY CLAIM IN ANY WAY CONNECTED WITH, OR ARISING FROM, THE EVENT OR THIS AGREEMENT, WHETHER IN CONTRACT, TORT, OR OTHERWISE (INCLUDING ANY NEGLIGENT ACT OR OMISSION), SHALL BE LIMITED TO THE AMOUNT PAID BY YOU TO RIGHT OF BOOM UNDER THIS AGREEMENT.
11.4 You agree that any and all disputes, claims and causes of action arising out of or connected with this program, shall be resolved individually, without resort to any form of class action.
12. COVID Policy
By attending the Right of Boom event, you certify that you do not fall into any of the following categories:
(1)(2) Individuals who have traveled at any point in the past fourteen (14) days either internationally or to a community in the U.S. that is experiencing sustained community spread of COVID-19; or (3) Individuals who believe that they may have been exposed to a confirmed or suspected case of COVID-19 or have been diagnosed with COVID-19 and are not yet cleared as non-contagious by state or local public health authorities or the health care team responsible for their treatment.
DUTY TO SELF-MONITOR. By registering to attend an in-person Right of Boom event, you agree to self-monitor for signs and symptoms of COVID-19 and contact Right of Boom immediately if you experience symptoms of COVID-19 within fourteen (14) days after attending an in-person Right of Boom event. Right of Boom also encourages you to take action to inform other attendees with whom you were in close contact at the event. Due to the nature of the event, Right of Boom cannot guarantee, and does not represent, that it will or can inform everyone who was in close proximity to a person with a possible COVID case of the potential exposure.
LIABILITY WAIVER AND RELEASE OF CLAIMS. You acknowledge that you derive personal benefit from your attendance at this in-person Event and willingly engage in this Event. By registering for the Event, you hereby release, waive and forever discharge any and all liability, claims, and demands of whatever kind or nature against Right of Boom and its owners, parent companies, subsidiaries, affiliates, including but not limited to respective officers, directors, employees, and its speakers and exhibitors, including in each case, without limitation, their affiliates, directors, officers, employees, volunteers, and agents (the "Released Parties"), either in law or in equity, to the fullest extent permissible by law, including but not limited to damages or losses caused by the negligence, fault or conduct of any kind on the part of the Released Parties, including but not limited to death, bodily injury, illness, economic loss, or loss or damage to property, which you, your heirs, assignees, next of kin and/or legally appointed or designated representatives, may have or which may hereinafter accrue on your behalf, which arise or may hereafter arise from your participation in the Event.
13. ASSUMPTION OF THE RISK.
By registering for the Event, you acknowledge and understand the following: Your attendance at an in-person Right of Boom event includes possible exposure to and illness from infectious diseases including but not limited to COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist. You knowingly and freely assume all such risks associated with the Event, even if arising from the negligence, fault or conduct of any kind on the part of the Released Parties. To the maximum extent permitted under applicable law, you accept and assume all risks of any and all personal injury or damage to your personal property that you may face while attending an Event, and hereby waive any claims you may have against the Released Parties. BY ATTENDING AND/OR PARTICIPATING IN THE EVENT, YOU ARE DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY LAW.
Your attendance of or participation in an Event or any related activities is completely voluntary. Right of Boom does not guarantee admittance to all or any part of any Event (including any session, breakout, keynote or other activity). Unless specified otherwise by Right of Boom, all event sessions, breakouts, keynotes or other activities, if applicable, are seated on a first-come, first-served basis.
Right of Boom reserves the right, including without prior notice, to limit the number of Event attendees and participants, to cancel or terminate any Event registration, to bar any person from attending all or any part of any Event, and to refuse to provide any person with access to Event materials.
14. Miscellaneous
Right of Boom’s failure to exercise any right provided for herein shall not be deemed a waiver of any further rights hereunder. Right of Boom shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond Right of Boom’s reasonable control. If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable. This Agreement is not assignable, transferable or sub-licensable by you except with Right of Boom’s prior written consent. This Agreement shall be governed by the laws of the State of Florida and the parties shall submit to the exclusive jurisdiction of the Hillsborough County courts in the State of Florida. A party that substantially prevails in an action brought under this Agreement is entitled to recover from the other party its reasonable attorneys’ fees and costs. Both parties agree that this Agreement is the complete and exclusive statement of the mutual understanding of the parties and supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of this Agreement, and that all modifications must be in a writing signed by both parties, except as otherwise provided herein. No agency, partnership, joint venture, or employment is created as a result of this Agreement and you acknowledge that you do not have any authority of any kind to bind Right of Boom in any respect whatsoever.
Right of Boom Events Code of Conduct
At Right of Boom, we believe in equality for all. As such, we are committed to creating event environments that are diverse, inclusive, safe, and free from discrimination, regardless of race, religion, color, national origin, sexual orientation, gender expression or identity, transgender status, age, disability, veteran or marital status, or any other classification protected by law.
All participants of Right of Boom events must abide by the following policy:
Expected Behavior
- Be considerate, respectful, and collaborative.
- Refrain from demeaning, discriminatory or harassing behavior and speech.
- Be mindful of your surroundings and of your fellow participants. Alert event staff if you notice a dangerous situation or someone in distress.
- Wear your badge at all times while at the event or event venues.
Unacceptable Behavior
Unacceptable behaviors may include but are not limited to:
- Harassment and discrimination includes any verbal, physical, or visual conduct based on sex, sexual orientation, gender expression or identity, transgender status, race, age, national origin, disability. Inappropriate use of nudity and/or sexual images in public spaces (including presentation slides); deliberate intimidation, stalking or following; harassing, photography or recording; sustained disruption of sessions, talks or other events; inappropriate physical contact, and any unwelcome sexual attention.
- Any boisterous, lewd or offensive behavior or language, using sexually explicit or offensive language or conduct, profanity, obscene gestures, or racial, religious or ethnic slurs.
- Wearing clothing that is not suitable for a professional work environment, that is provocative, inappropriate or otherwise potentially offensive.
- Possession of a weapon or any item that can be used as a weapon, which may be used to threaten or cause injury to others if used in a certain manner.
- Any destruction or vandalizing of personal property or event site or materials.
- Possessing any open can, bottle or other receptacle containing any alcoholic beverages, except in areas specifically designated for the consumption of alcohol or being intoxicated, as determined by Right of Boom, in any event venue or function. Please drink responsibly.
- Possessing any illegal substance. Right of Boom does not tolerate the use or abuse of illegal substances anywhere in the event venues.
- Smoking is not permitted, other than in designated areas.
- Assembling for the purpose of, or resulting in, disturbing the peace, or committing any unlawful act or engaging in any offensive behavior.
- Any other illegal activity not already covered above.
- Many event venues are shared with members of the public; please be respectful to all patrons of these locations.
- Failure to obey any of the rules or regulations of the event venues or instructions of the event staff.
- Sharing your event badge with other individuals.
Consequences of Unacceptable Behavior
Unacceptable behavior will not be tolerated. Anyone asked to stop unacceptable behavior is expected to comply immediately. If a participant engages in unacceptable behavior, the event organizers may take any action they deem appropriate, up to and including expulsion from the event without warning or refund and if appropriate involvement of local law enforcement.

If you experience or witness a life safety emergency, please contact your local authorities, in North America dial 911, immediately.
If you have a complaint or concern about harassment, discrimination, bullying or any other conduct that violates the Right of Boom Events Code of Conduct, we encourage you to tell an event staff member or security personnel immediately or send an email to events@rightofboom.com.
If you witness this happening to someone else, please report that, too. You may request that your report remain completely confidential.
After event hours, if you see something suspicious or would like to report a security issue, remember to See Something, Say Something by calling local authorities.
Updates
The Code of Conduct may be revised at any time by Right of Boom and the terms are non-negotiable. This Code of Conduct is without prejudice to Right of Boom's rights, all of which it expressly reserves.

This Privacy Notice explains the information practices and policies of Right of Boom, LLC ("Right of Boom"). This Privacy Notice describes how we collect, use, and disclose Personal Information of: (a) individuals (i.e. employees or other staff users) of business partners or event attendees (collectively "clients") that use our services; (b) individuals (i.e. employees or other staff users) of any prospective business partners or clients; and/or (c) any visitors to any websites owned by Right of Boom ("Right of Boom Websites").
For the purposes of this Privacy Notice, the terms "we", "us" and "our" refer to Right of Boom and "you" refers to you, anyone whose information we process for the purposes above. "Personal Information," means information that relates to an identified or identifiable person such as a name, address, phone number, username, email address, and password, it might also include information such as an IP addresses and/or other online identifiers and information related to a device (see "Cookies or Similar Technologies" section).
This Privacy Notice does not reflect the privacy policies or practices of our clients or any other third party. Right of Boom is not responsible for the privacy policies or practices of any client, end-clients of clients or other third party.

I. About Right of Boom
Right of Boom is an IT events company that provides training and educational services to our customers (collectively, the "Services").
In using our Services, our clients may store or otherwise process business or other information or allow us to have access to such information, including Personal Information on our Services ("Client Information").
In providing our Services, we process Client Information on behalf of and under the direction and instruction of our applicable Client. It is the responsibility of Right of Boom's Client to ensure that the Client Information that it collects stores or otherwise processes or allows us to access through the client's use of Right of Boom’s Services has been legally collected and is processed in accordance with applicable data protection laws. If you have any questions about the handling of Client Information or if you want to submit any requests for access to, correction, amendment, or deletion of Client Information, please address your concerns to the applicable Client.
Right of Boom does use limited Personal Information collected via the Services and the Right of Boom Websites for our own purposes, as described in this Privacy Notice.
II. How We Collect, Use, and Share Personal Information
We primarily collect, access, use, and share Personal Information where necessary for us to market and provide Services to our clients and in the ordinary course of running our business, including through the receipt of communications such as emails, website enquiries and telephone calls.
Personal Information Collected through Our Services and Right of Boom Websites
We may collect Personal Information through our Services and Right of Boom Websites in the following ways:
Information That You Provide To Us Voluntarily
General Contact Information. We collect any Personal Information that you voluntarily provide to us when you visit a Right of Boom Website or when you subscribe for or enquire about any of our Services. For example, if you submit a sales enquiry or subscribe for a newsletter via a Right of Boom Website web form or request additional information or contact from Right of Boom via email, you will provide us with certain Personal Information, which may include names, company name, address, and email address.
In addition, if you choose to communicate with us via a web form, email, or by telephone, we will keep a copy of our communication together with your email address or phone number and our responses.
Personal Information That We Collect Automatically
Device-related Information. When you visit any Right of Boom Website or use our Services, we collect Personal Information from your device, including IP address, device type, unique device identification numbers, browser-type, broad geographic location (e.g. country or city-level location), the date and time of use of our Services, the date and time of an event on the client’s IT systems, system logs, and technical attributes about the device or a web browser. In some countries, including countries in the European Economic Area (EEA) and the United Kingdom (UK), this information may be considered Personal Information or "personal data" under applicable data protection laws. This Personal Information enables us to better understand the use of our Right of Boom Websites and Services. Some of this Personal Information may be collected using cookies and similar tracking technology, as explained further under the heading "Cookies or Similar Technologies" below.
Cookies or Similar Technologies
Right of Boom Websites use cookies. A "cookie" is a string of alphanumeric characters. There are two types of cookies that may be used at Right of Boom's Websites: persistent cookies or session cookies. A persistent cookie gets entered by your Web browser into the "Cookies" folder on your computer and remains there after you close your Web browser. Persistent cookies may be used by your browser on subsequent visits to the site; however, session cookies are held temporarily in your computer's memory and disappear after you close your browser or shut off your computer.
If you have arrived at any Right of Boom Website by clicking on a banner ad for one of Right of Boom's products or services, a session cookie may be used. This cookie contains an identification number for the advertisement that you clicked on, and it helps Right of Boom determine which of its ads attracts the most visitors. Personal Information That We Obtain From Third Party Sources
Commercially Available Personal Information. Right of Boom may also collect Personal Information from commercially available sources but only where we are legally permitted to do so. Such Personal Information may include names, addresses, email addresses, and demographic data. The Personal Information Right of Boom collects from these commercial sources may be combined and cross-referenced with Personal Information we collect through the Services. We use this Personal Information for communications purposes to provide direct marketing materials for our business customers or prospects.
From time to time, we may also ask our partners or clients to voluntarily provide us with the email addresses of contacts of other organizations, so they too can benefit from the various products and services offered by Right of Boom and Right of Boom's trusted affiliates. Where we do, we will confirm that they have the permission to pass on these details to us.
How We Use Personal Information Collected through Our Services and Right of Boom Websites
- To Serve Our Clients. We use the Personal information we collect, to provide our Services to the Clients on whose behalf we are acting.
- To Serve You. We use the Personal Information to respond to any request or query directed to us (for example through web forms or email), to provide you/your organization with our products and Services and to manage our relationship with you. For example, we address any enquiries or complaints you may have, endeavor to improve the Services we provide, or provide you with information about other products and services we offer that we think you may be interested in.
- For Direct Marketing. If we have the right to do so, we will use your Personal Information for the purposes of direct marketing communications to your organization, such as by adding your contact and other details to a marketing database. Where we do, we will provide you with an opportunity to opt out in accordance with section III.
- For Internal and Service-Related Purposes. We may use any Personal Information we collect through the Services and/or any Right of Boom Websites for internal and service-related purposes, including providing it to third parties as necessary to allow us to provide the Services, maintain or improve Right of Boom Website security, and/or invoicing for example.
- Anonymized and Aggregate Data. From time to time, we will aggregate Personal Information collected through our Services for analytics purposes, product improvement purposes and other service-related purposes.
How We May Disclose Personal Information Collected through Our Services and Right of Boom Websites

With Our Companies, Third-Party Vendors and Service Providers. As appropriate, we may share Personal Information with any of our group companies including those listed in schedule 1, vendors and/or service providers in connection with the provision or marketing of the Services, Right of Boom Websites. These third parties have access to Personal Information to the extent necessary to permit them to do their jobs, however, they are bound by confidentiality agreements before any Personal Information is provided to them, and they are restricted from using the Personal information for other purposes.
For Personal Information previously transferred to us from EEA countries and the UK under the EU-US Privacy Shield, we will remain liable under the Privacy Shield Principles if our agents or service providers process such Personal Information in a manner inconsistent with the Privacy Shield Principles, unless we prove that we are not responsible.
As Required by Law and Similar Disclosures. We may disclose Personal Information: if we believe it is necessary: to comply with national security or law enforcement requests and legal process, such as a court order or subpoena; to respond to your requests; to prevent or address fraud, security, or technical issues; or to protect our property or other legal rights or the rights or property of others, or to protect the vital interests of others.
Merger, Sale, or Other Asset Transfers. If we are involved in a potential or actual merger, acquisition, financing, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider Personal Information collected through the Services or Right of Boom Websites (or both) may be sold or transferred as part of such a transaction, as permitted by law and/or contract.
Other than as stated in this Privacy Notice, we will not release Personal Information to unaffiliated third parties, and we will not cross-reference Personal Information collected through one Client’s use of our Services with that of any other Client or entity.
How We Use Personal Information Collected For Targeted Advertising.
We share Personal Information with companies involved in targeted (i.e. interest-based) advertising. Targeted advertising is advertising that is targeted to you based on your web browsing and app usage over time through the use of Cookies and other devices. This targeted advertising consists of Right of Boom [and third-party ads] that are personalized and displayed on Right of Boom Websites and through other channels. We share various types of de-identified Personal Information (i.e. Personal Information that does not disclose your name) to enable interest-based advertising.
You have the option to restrict the use of Personal Information for targeted advertising and to opt-out of receiving targeted ads.

How do we transfer and store your Personal Information?
Right of Boom Websites Services and systems use servers located in the United States. If you are located outside of the United States, the Personal Data we collect will be processed and stored in the United States, a jurisdiction in which the data protection and privacy laws may not offer the same level of protection as those in the country where you are located.

Access, Correction & Deletion of my Personal Information
If you wish to request access to, correction, or deletion of Personal Information you have submitted through the Right of Boom Websites, you can log into your account or contact Right of Boom at events@rightofboom.com. If you are located in the EEA or the UK, you may have additional rights which we have set out in Section IV below.
Data Integrity and Purpose Limitation
Right of Boom will use Personal Information only for the purpose of or in ways compatible with the purposes for which it was collected.
Information Retention
We keep Personal Information we need to provide our Services only for as long as we have a valid business purpose, in accordance with applicable law and our Client agreements. For example, we retain Personal Information for as long as it is needed to provide you with Services you have requested or to comply with applicable legal, tax or accounting requirements.
When we have no ongoing legitimate business need to process your Personal Information, we will delete it. If immediate deletion is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible or unless as otherwise required by law.
User Choices
We include an "unsubscribe" hyperlink in Right of Boom marketing emails for those users who wish to stop receiving email communication from Right of Boom. The hyperlink will connect to one the Right of Boom Websites, which will confirm the email address that has been automatically unsubscribed and will no longer receive emails from Right of Boom.
IV. Security
We take steps to ensure that Personal Information is treated securely and in accordance with this Privacy Notice which includes appropriate technical and organizational measures. These measures are designed to provide a level of security appropriate to the risk of processing your Personal Information. However, neither the Internet nor any form of electronic storage can be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any Personal Information provided to us.

Right of Boom is headquartered in the US, but we are a growing corporation with operations in multiple countries. In using Right of Boom Websites, Services and/or otherwise contacting us you acknowledge that your information may be accessed and processed around the world, to us in the United States or to our affiliates, partners, merchants, or service providers elsewhere in the world. However, we have taken appropriate safeguards to require that your Personal Information remains protected in accordance with the terms of this Privacy Notice and applicable data protection laws. Where required by EEA/UK law, we have entered into standard contractual clauses approved by the European Commission to provide appropriate safeguards for international Personal Data Transfers from the EEA and UK.

In some cases, we may also have a legal obligation to collect Personal Information from you, such as KYC checks or tax information.
If we ask you to provide Personal Information to comply with a legal requirement or to contact you, we will make this clear at the relevant time and advise you whether the provision of your Personal Information is mandatory or not (as well as of the possible consequences if you do not provide your Personal Information). Similarly, if we collect and use your Personal Information in reliance on our legitimate interests (or those of any third party), we will make clear to you at the relevant time what those legitimate interests are and before doing so will ensure that we have considered your rights and interests

Your Rights

- You can object to processing of your Personal Information, ask us to restrict processing of your Personal Information or request portability of your Personal Information.
- You have the right to opt-out of marketing communications we send you at any time. In addition to using our contact details below, for email marketing communications you can exercise this right by clicking on the "unsubscribe" or "opt-out" link in the marketing emails we send you.
Similarly, if we have collected and processed your Personal Information on the basis of your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your Personal Information conducted in reliance on lawful processing grounds other than consent.

Please note, if you are an individual whose personal information Right of Boom processes as a "data processor", for example to provide services on behalf of its Clients, you must contact the relevant data controller of your Personal Information in order to exercise your rights. This might be one of our Clients or one of our Clients' customers.
VIII. For users in Australia
Right of Boom complies with the Australian Privacy Principles as set out in the Privacy Act 1988 ("Privacy Act") regarding the collection, storage, use and disclosure of Personal Information from Australian users.
In addition to the uses set out in the section titled "How We Use Information Collected through Our Services and Right of Boom Websites", we may also use your information, including Personal Information, for a secondary purpose that is related to a purpose for which we collected it, where you would reasonably expect us to use your Personal Information for that secondary purpose.
Under the Privacy Act, we have an obligation (the "Obligation") to take reasonable steps, in the circumstances, before disclosing Personal Information to an overseas recipient to ensure that the overseas recipient does not breach privacy laws in relation to that information. However, should we obtain your consent to disclose your Personal Information to an overseas recipient, the Obligation does not apply. In obtaining your consent, we will not be accountable, and you will not be able to seek redress against us under the Privacy Act if the overseas recipient handles your Personal Information in breach of the Australian Privacy Principles ("APPs") under the Privacy Act. In providing your consent under this Privacy Notice, you acknowledge and agree to the risks associated with the disclosure of your Personal Information overseas. These risks may include the overseas recipient not being subject to any privacy obligations or privacy principles similar to the APPs and the overseas recipient being subject to foreign law that could compel the disclosure of your Personal Information to a third party, such as an overseas authority.
If you are a user in Australia and wish to access, correct or update your information in accordance with section III, Right of Boom may refuse certain requests but only in circumstances where this is permitted under the Privacy Act.
IX. Children’s Privacy
We do not knowingly collect, store, or use information from children, including those under the age of 13. If you are under the age of 13, you may not submit any information through the Right of Boom Websites or Services. If you have reason to believe that a child under the age of 13 has provided information to us through the Right of Boom Websites or Services, please contact us and we will endeavor to delete that information from our databases.
X. Do Not Track
The Right of Boom Websites currently do not respond to "Do Not Track" (DNT) signals and operate as described in this Privacy Notice whether or not a DNT signal is received.
XI. Your California Privacy Rights (California Residents Only)
Under Section 1798.83 of the California Civil Code, residents of California have the right to request from a business, with whom the California resident has an established business relationship, certain information with respect to the types of Personal Data the business shares with third parties for those third parties' direct marketing purposes, and the identities of the third parties with whom the business has shared such data during the immediately preceding calendar year.
To exercise your rights, you may make one request each year by emailing us at events@rightofboom.com with "Request for California Privacy information" on the subject line and in the body of your message. Be sure to provide in the request sufficient information to properly identify you and/ or the members of your family.
Right of Boom processes certain personal information as a business under the California Consumer Privacy Act (CCPA). This personal information relates to business transactions within the scope of Section 1798.145(n) of the CCPA. [California residents have limited rights under the CCPA in connection with this personal data. Right of Boom offers the right to opt out of the sale of this personal information on the Right of Boom websites.]
XII. Changes to This Privacy Notice
We may update this Privacy Notice to reflect changes to our information practices from time to time. If we decide to change this Privacy Notice, we will post the changes on this page so visitors to the Right of Boom Website and our clients and the users of their IT systems are aware of our practices, and we will change the "Last Updated" date above. If we make a material change to our information practices, such as to how we use Personal Information, we will make reasonable efforts to provide notice on our website and/or through our clients and obtain consent to any such uses as may be required by law.

If your complaint cannot be resolved through Right of Boom’s internal process, we have further committed to refer such complaints, under the EU-US Privacy Shield Principles to utilize JAMS as an alternative dispute resolution provider. In addition, EU individuals have the right to complain to EU data protection authorities.
